INVASION OF PRIVACY
Under Massachusetts law “A person shall have a right against unreasonable, substantial or serious interference with his privacy.” In the employment context, right to privacy issues can arise concerning the release of confidential information contained in an employee's personnel file, the release of medical or mental health information concerning an employee, statements made to prospective employers by a prior employer, drug tests, computer monitoring, and video and audio surveillance.
